KB TRUCKING & HAULING LLC - Terms of Service

1. Definitions

Carrier: Refers to KB Trucking & Hauling LLC, headquartered in Novi, Michigan.

Shipper: The party or entity requesting transportation services and responsible for the freight.

Consignee: The party designated to receive the freight at the final destination.

Freight: Any goods, cargo, or materials moving under this agreement.

2. Service Agreement

Engagement of KB Trucking & Hauling LLC constitutes an acceptance of these service conditions. We provide regional, short-haul, and specialized transportation logistics. While we maintain a 24/7 logistics powerhouse infrastructure, delivery schedules are provided as estimates and not guarantees unless specified via a written expedited service agreement.

3. Rates & Payment

Invoices are generated upon successful freight pickup. Standard payment terms are Net 30 days unless otherwise negotiated in writing. KB Trucking & Hauling LLC reserves the right to apply:

• Fuel Surcharges: Adjusted weekly based on regional DOE averages.
• Accessorial Charges: Detention, layover, and driver-assist fees will be applied as incurred.
• Late Fees: Interest at 1.5% per month on balances exceeding 30 days.

4. Liability & Claims

Our liability for loss or damage is limited to $100,000 per shipment unless additional coverage is requested in writing and paid for prior to dispatch. All claims for loss, damage, or delay must be filed in writing with KB Trucking & Hauling LLC within nine (9) months after the delivery or reasonable delivery date, supported by a verifiable proof of loss document.

5. Shipper Obligations

The Shipper is responsible for ensuring all cargo is securely packaged, labeled, and accompanied by accurate Bills of Lading (BOL). Any hazardous materials must be declared in full compliance with DOT regulations. KB Trucking & Hauling LLC reserves the right to refuse cargo that is improperly prepared for transport.

6. Governing Law

These terms and any disputes arising from our services shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. Exclusive jurisdiction for any legal action shall lie in the courts of Oakland County, Michigan.
